Rauch Contests Northstar Offer

Court Grants Radko Extension

Gastonia, NC — Rauch Industries, owner of the Christopher Radko brand of ornaments, has objected to the recent offer of factory-direct ornament sales sent by Northstar, the Polish company which manufactures about 80 percent of Radko brand ornaments. Rauch is currently suing Radko personally, alleging, among other things, that Radko secretly owns Northstar, and overcharged the company by millions of dollars.

Aldus Chapin, chairman of Rauch, told Gifts & Decorative Accessories, “Northstar’s solicitations are a direct attempt to confuse our customers and violate our intellectual properties rights. But we will vigorously protect the rights of Rauch and its customers to receive authentic Christopher Radko ornaments.” Though Northstar’s solicitation did not explicitly offer Radko ornaments for sale, it did state that Northstar makes Radko wares. It remains to be seen whether Northstar’s play for direct sales will affect the ongoing litigation.

The latest development in the case is that Radko received an extension to reply to Rauch’s latest court filing. After a delay to allow the parties to attempt an out of court resolution, Rauch returned to the docket of the United States District Court, Western District of North Carolina, Charlotte Division, on August 6 to contest Radko’s motion to dismiss one count of the complaint. Radko’s response would have been due August 20, had the Court not granted a four-day extension. The defense requested the extra time on the grounds of schedule conflicts, which prevented Radko’s attorneys from conferring with Rauch’s counsel.
