Bill Proposes to Revise CPSIA

Washington, DC - On May 12, Rep. Bono Mack's Subcommittee on Commerce, Manufacturing, and Trade favorably reported draft legislation to reform the Consumer Product Safety Improvement Act (CPSIA). The bill, known as the "Enhancing CPSC Authority and Discretion Act of 2011" or ECADA, aims to reduce the regulatory burdens created by CPSIA where possible while protecting consumers; to enhance the Consumer Production Safety Commission's (CPSC) ability to investigate complaints and to prioritize testing based on cost-benefit analysis; and, to improve the utility and accuracy of information in the CPSC's public database.

The bill narrows lead limitations to only those products intended for children under 6 which can be placed in the mouth, as well as exempting the sale of used children's products other than metal jewelry and products the donator or seller specifically knows to violate the lead standard, among other changes.

The bill passed out of Subcommittee by a voice vote and is scheduled to be considered by the full Energy and Commerce Committee the week of May 23.
